1. Publisher and acceptance

The MEMO – Histoires du jour app (“MEMO”, “the app”) is published by Thomas Vorgeat — contact: memoappli.contact@gmail.com.

By downloading or using MEMO, you accept these terms of use. If you do not accept them, please do not use the app. These terms apply to all versions of MEMO, available on the App Store (iOS 17.6 or later) and on Google Play (Android). Current version of the app: 1.5.2.

2. Description of the service

MEMO is an educational and cultural app that lets you discover, every day, anecdotes and stories linked to the current date. The service includes, in particular:

3. User account and guest mode

3.1 Guest mode

Basic use of MEMO does not require an account: your favorites and your progress are then saved locally on your device, with an anonymous server-side backup of your progress and your trial status (see our privacy policy). Creating a free account lets you sync your data across several devices and keep it if you change phones.

4.1 Plans and prices

MEMO offers an optional Premium subscription, available as a monthly or annual plan. The exact price applicable in your country is always shown in the app before any purchase.

4.2 Free trial

A free trial (usually 3 days, sometimes 7 days depending on the current offer) may be offered so you can try Premium. Unless canceled before the end of the trial, the paid subscription starts automatically when the trial period ends. The length of the trial and the price that will follow are shown in the app before you subscribe.

Payments are processed exclusively by Apple (App Store) or Google (Google Play): MEMO never has access to your banking data. Refund requests are subject to Apple's and Google's terms and must be sent to them directly (via reportaproblem.apple.com or Google Play support).

4.5 Right of withdrawal

In accordance with the French Consumer Code, by agreeing to immediate access to Premium content at the time of purchase, you acknowledge that the service is fully performed as soon as it is activated. Any withdrawals and refunds are handled according to the Apple and Google procedures mentioned above.

6.1 MEMO content

All elements of the app (story texts, illustrations, graphics, logos, software, structure) are protected by intellectual property law and remain the property of the publisher or its licensors. The historical facts recounted are in the public domain; their wording, selection and presentation remain protected.

6.2 License to use

We grant you a personal, limited, non-exclusive and non-transferable license to use the app, for strictly personal and non-commercial purposes.

8. Limitation of liability

The app is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the publisher cannot be held liable for indirect damages resulting from the use of, or the inability to use, the app. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, nor your statutory rights as a consumer.

9. Termination

9.1 By you

You can stop using the app at any time and delete your account from the app's settings (see also our privacy policy). Deleting your account does not cancel an ongoing subscription: it must be canceled via the App Store or Google Play (section 4.3).

We reserve the right to suspend or terminate access to the service in the event of a serious or repeated breach of these terms.

10. Changes to the terms

We may change these terms at any time, in particular if the service or the regulations change. The version in force is the one published on this page, with its update date. In the event of a significant change, we will let you know in the app; continuing to use the app after such notice constitutes acceptance of the new terms.

11. Governing law and disputes

These terms are governed by French law. In the event of a dispute, we invite you to contact us first at memoappli.contact@gmail.com in order to seek an amicable solution. Failing that, the dispute may be brought before the competent French courts, in accordance with the ordinary rules of law. In accordance with the French Consumer Code, you may also use, free of charge, a consumer mediator or the European online dispute resolution platform (ec.europa.eu/consumers/odr).
